How does wage garneshment work for someone who works for tips?

If you make below minimum wage and work for tips, what happens when someone tries to garnish your wages?

  1. u get screwed over
  2. Federal law allows garnishment of up to 25% of your net weekly take-home after-tax pay, but there is a floor, and if you are receiving less than minimum wage, it is possible that your wages cannot be attached at all.
  3. Great Question! If you have no wages they can't be garnished...it seems to me. Garnishment is served on the employer and he/she deducts it from a wage. Can your tips be confiscated and then garnished? You can get some free advice here www.freeadvice.com/
  4. They have a formula that adds tips to your wages. So if you don't make much off tips you get screwed. the top I think is 20 some percent of your after tax income. But your wage may be too low to to garnish
  5. Not sure, but they may garnish your tax refund
